Understand the Main Legislation for Safeguarding Children

Unit 333 – Understand how to safeguard the wellbeing of children and young people. Outcome 1 – Understand the main legislation, guidelines, policies and procedures for safeguarding children and young people. The safe guarding of children has only been developed in the last 50 years. However it is a vital part of working with children. The legislations, guidelines and policies for safeguarding are updated all the time for the best interest of the children.The current legislations are as follows; * The Children Act 1989 – this act shows the responsibilities of parents and professionals when ensuring children’s safety. There are two important sections which focus on child protection. Section 47 – the local authority has a duty to investigate when they have reasonable cause to suspect that a child in their area is suffering significant harm. Section 17 – services must be put in place to safeguard and promote the welfare of children in the area wh o are in need.The main aims of this act where to achieve a balance between protecting children and the rights of parent to challenge state intervention, encourage partnership between statutory authorities and parents, restructure the framework of the courts in particular with regards to family proceedings and finally redefining the concept of parental responsibility. * Every Child Matters are the guidelines which lead to the Children Act 2004.The main points of the act are, there should be a much closer relationship between agencies such as health professionals, schools and welfare services, there should be a shared data base of information which if relevant to the safety and welfare of children, Earlier support for parent experiencing problems, Ofsted to set a frame work that will monitor children’s services. This became a legal requirement and Local safeguarding children boards (LSCB) were formed to carry out these different things. Education Act 2002 – Sets out the responsibilities of local education authorities, governing bodies, head teachers and all those working in schools to ensure children are safe and free from harm. * The United Nation Convention on the rights of the Child 1989 (UNCRC) – Protects the rights of children, setting out the guidelines for what a child is entitled to regardless of their background treat every child as equal and respecting their human rights.Things such as, a right to education and health care, the right to grow up in a loving happy and understanding environment, the right to develop personalities abilities and potential to the best of their abilities and the right to special protection measures or assistance. The UK signed this legislation in 1990 and ratified it in 1991. * The Common assessment framework (CAF) aims to determine whether a child has additional needs at a young age and support this to make sure their needs are met. The department of education provides guidance for the local authorities including schools in two different policies which are, working together to safeguard children 2010 (sets out the duties of organisations and how they must work together to safeguard children) and what to do if you’re worried a child is being abuse 2006 (looks at the actions all adults should take if they are concerned about child). There are many guidelines, policies and procedures that affect our day to day work when safeguarding children.As we follow all these policies and procedures it affects they way in which we work with children for example the child protection policy, this makes it our responsibility to record and report if there is a child that raises concerns of suspected abuse. The school will also have to check that and concerns are investigated and followed up and also that if any photos are taken of the children that parents have given permission for this. Another procedure would be the risk assessments that are carried out daily.This is part of the daily routin e but when looked at from a different perspective it is another procedure that is set out to safeguard children. It is put in place to make sure that the children are safe and free from harm whilst in the setting and any concerns about safety are reported and sorted before the children are allowed to either play with that equipment or go in the area to ensure they are safe. Making sure that a situation that could potentially cause harm is safe and fine to use.Ensuring the voice of a child is heard, all agencies involved in the safeguarding of children will ensure that the voice of the child is heard particularly in times of distress or trauma as then the support they need can be given. The LSCB are set up by the local authority to make sure that all children are being looked after and the safeguarding and wellbeing of children is being followed. Also if a school has a concern about a child the LSCB will make sure outside agencies work together for the best interest of the child.The Childcare practice is an important policy that all childcare or schools will have to follow that is from nannies all the way through to schools. All professionals working with children will have to ensure that they have a criminal record bureau (CRB) before starting work. Each organisation will also have to show that they are following the correct safeguarding policies and procedure when dealing with situations and also when reporting them.All of these guidelines are use not only locally but nationally to ensure that all the children are safe and their well-being is top priority on a day-to-day basis. When report a safeguarding issue it is vital that the guidelines are followed and followed correctly. Child protection is the term used when referring to the policies and procedures put in place to protect children and young people against suspicion or harm or abuse.Safeguarding has widely started to replace the term child protection when in the context of adults working with children and managing the issues relating to child protection, this is because it has a wider definition of the ways that adults will react to these issues. This has been design to prevent the risks of harm rather than react to them. The LSCB regulations of 2006 states that serious case reviews (SCRs) will be required in situations where a child dies due to known or suspected abuse or neglect. It may be the case if a child has suffered serious or even life threatening injuries.The purpose of a SCR is for agencies to discuss and determine what lessons have been learned from the situation and how the professionals need to work in the future. Then a report for the public will be composed so recommendations are known. The data protection act 1998 sets out the way that a school keeps and store information. Under this act the information gathered for safeguarding and children protection should only be used for this reason and if the pupil concerned or their parents wish to see this information the y have a right to access it.There are a few exceptions to this rule such as, * Information which may cause serious harm or risk of abuse to health of the pupil. * Information given to a court or in adoption or parental order records * Copies of examination scripts or marks prior to their release * Unstructured personal information, or information which is held manually and not in school records. They are also entitled to their own educational records as well.

These were the sentiments expressed during Sheryl Sandburg book promotion tour in early 2013. Mrs Sandberg is largely accepted as one of the most successful female businessperson in modern society. During her many lectures and academic interviews she essentially cited her success as the result of going against the gender norm for women. Although specifically referring to the business world, does Sheryl have a point? Are we reinforcing gender roles in the words we promote and discourage our children to use? It is largely accepted across both linguistic and psychology fields that girls develop their language skill in: understands, quantity, quality and range of vocabulary acquired at an earlier age and faster rate than their male counterparts. A very recent study by Rikard Bauman in 2010 (Stockholm University Press) explored vocabulary growth and language production in pre-school children. It is suggested that at 22 months girls have a more extensive vocabulary than boys due to capacity differences; however, at 34 months such a pattern cannot be found. Furthermore it is suggested that gender affects language production in the sense that male and female speakers will prefer to produce words that are associated with their culture’s definition of masculinity and femininity. The study on vocabulary growth is based on the assumption that TTR (type/token ratio) reflects vocabulary size and it proves that, at 22 months, girls have a more extensive vocabulary than boys; however, at 34 months such a pattern is less obvious, if any conclusion can be drawn it is that boys have a slightly larger vocabulary than girls. The study on language production is focused on verb production and it shows that boys and girls prefer verbs that are associated with common stereotypes of masculinity and femininity. It seems that these gender distinctions are not unique to the English language or the Western world as Found when examining the Japanese language. according to Eleanor Harz Jorden, when learning language in Japan children learn that there are some words and some grammatical constructions that are associated explicitly with men or boys, while others are associated with women or girls. Such differences are sometimes called gendered language. In Japanese, speech patterns associated with women are referred to as onna kotoba (womens words) or joseigo , womens language). In general, the words and speech patterns associated with men are seen as rough, vulgar, or abrupt, while those associated with women are considered more polite, more deferential, or softer. Some linguists consider the rough/soft continuum more accurate than the male/female continuum. For example, Eleanor Harz Jorden in Japanese: The Spoken Language refers to the styles as blunt/gentle, rather than male/female. There are no gender differences in written Japanese (except in quoted speech), and almost no differences in polite speech (teineigo), since males take on softer speech, except for the fact that women may be more likely to use polite speech in the first place. The word onnarashii , which is usually translated as ladylike or feminine, refers to the behaviour expected of a typical Japanese woman. As well as behaving in particular ways, being onnarashii means conforming to particular styles of speech. Some of the features of women’s speech include speaking in a higher register, using more polite forms and using polite speech or honorifics in more situations, and referring to themselves and those they address more formally. Some linguistic features commonly associated with women include omission of the copula da, the use of personal pronouns such as watashi or atashi among others, use of feminine sentence-final particles such as wa, na no, kashira, and mashoo, and the more frequent use of the honorific prefixes o and go. According to Katsue Akiba Reynolds, ladylike speech is instrumental in keeping Japanese women in traditional roles and reflects Japanese society’s concept of the difference between women and men.[4] For example, there is the potential for conflict for women in the workplace in that, to be onnarashii, a woman must speak politely, submissively and humbly, yet to command respect as a superior, she must be assertive, self-assured, and direct, even when dealing with male subordinates. Actual language used by Japanese-speaking women differs from these ideals. Such onnarashii speech is a norm that institutions such as education and media encourage women to adopt. Similarly, these forms may be prescribed for women learners by Japanese textbooks and other materials. There are, however various deviations from these norms in conversation. Although Japanese women may not follow the gender norm in speech, some linguistic studies indicate that Japanese women tend to use more honorific language than men do, which reinforces the idea of onnarashii and traditional gender roles.[5] Traditional characteristics of Japanese mens speech [edit] Just as there are modes of speaking and behaviour that are considered intrinsically feminine, there are also those that are considered intrinsically masculine. In speech, being otokorashii (manly or masculine) means speaking in a lower register, using fewer polite forms and using them in fewer situations, and using intrinsically masculine words. Research on Japanese mens speech shows greater use of neutral forms, forms not strongly associated with masculine or feminine speech, than is seen in Japanese womens speech. Scholars argue that men use typically masculine forms to assert their own authority and knowledge of themselves. Some studies of conversation between Japanese men and women show neither gender taking a more dominant position in interaction. Men, however, tend to show a self-oriented conversation style, telling stories and expressing their expertise on topics being discussed, than is typical of women in these studies. Gender differences in modern society :- As women gain an increasing leadership role in Japanese society, notions of onnarashisa and otokorashisa, that is, what is deemed appropriate behaviour for men and women, have evolved over time. Although comparatively more extreme movements call for the elimination of gender differences in the Japanese language (gender-neutral language), convergence in usage is considered unlikely and may not even be desirable. Instead, trends in actual usage indicate that women are feeling more comfortable using traditional characteristics of female speech (such as wa) while still maintaining an assertive attitude on par with men. In other words, there is a gradual decoupling of language forms and traditional cultural expectations. Although the characteristics of Japanese male speech have been largely unaffected, there has been an increasing sensitivity regarding certain usages (such as changing the terms used to refer to mature women -chan) that may be considered offensive. Regional dialect may often play a role in the expression and perception masculinity or femininity of speech in Japanese. Another recent phenomenon influencing established femininity in speech is the popularity of Okama, very feminine men as popular Geinoujin (television personalities). While homosexuality and transgenderism is still a fairly taboo subject in Japan, lesbians with male traits, or cross-dressers, are referred to as onabe or tachi. Problems for Japanese learners [edit] Without the proper instruction by fluent Japanese speakers and/or teachers, non-native persons risk learning and expressing themselves inappropriately to native Japanese. Compounding the difficulty of language acquisition, formal instruction may emphasise learning the polite forms of expression (that favour female students) while glossing over informal expression (that favour male students) and honorifics (distinguishes natives from foreigners). It is important for non-natives to be instructed by members of the same sex or be aware that mere mimicry may not have the expected results. In addition to the use of pronouns to refer to oneself and others, the use of titles also is strongly influenced by gender-based overtones and is another source of potential problems for the non-native speaker. The situation is further complicated by regional variation. For example, in many regions of Japan it is common for older men to refer to themselves as boku or older women to refer to themselves as ore. Burman, research associate in Northwesterns Roxelyn and Richard Pepper Department of Communication Sciences The researchers measured brain activity (using functional magnetic resonance imaging) in 31 boys and in 31 girls aged 9 to 15 as they performed spelling and writing language tasks. The tasks were delivered in two sensory modalities visual and auditory. When visually presented, the children read certain words without hearing them. Presented in an auditory mode, they heard words aloud but did not see them. Using a complex statistical model, Burman and Pepper accounted for differences associated with age, gender, type of linguistic judgment, performance accuracy and the method (written or spoken) in which words were presented. The researchers found that girls still showed significantly greater activation in language areas of the brain than boys. The information in the tasks got through to girls language areas of the brain (areas associated with abstract thinking through language). And their performance accuracy correlated with the degree of activation in some of these language areas. To their astonishment, however, this was not the case for boys. Boys accurate performance when reading words depended on how hard visual areas of the brain worked. In hearing words, boys performance depended on how hard auditory areas of the brain worked. If that pattern extends to language processing that occurs in the classroom, it could inform teaching and testing methods. Given boys sensory approach, boys might be more effectively evaluated on knowledge gained from lectures via oral tests and on knowledge gained by reading via written tests. For girls, whose language processing appears more abstract in approach, these different testing methods would appear unnecessary. One possibility is that boys have some kind of bottleneck in their sensory processes that can hold up visual or auditory information and keep it from being fed into the language areas of the brain, Burman said. This could result simply from girls developing faster than boys, in which case the differences between the sexes might disappear by adulthood. Or, an alternative explanation is that boys create visual and auditory associations such that meanings associated with a word are brought to mind simply from seeing or hearing the word. While the second explanation puts males at a disadvantage in more abstract language function, those kinds of sensory associations may have provided an evolutionary advantage for primitive men whose survival required them to quickly recognise danger-associated sights and sounds. If the pattern of females relying on an abstract language network and of males relying on sensory areas of the brain extends into adulthood (a still unresolved question) it could explain why women often provide more context and abstract representation than men. Ask a woman for directions and you may hear something like: Turn left on Main Street, go one block past the drug store, and then turn right, where theres a flower shop on one corner and a cafe across the street. Such information-laden directions may be helpful for women because all information is relevant to the abstract concept of where to turn; however, men may require only one cue and be distracted by additional information. Customer commodities are turning homogenous all over the world with this fact comes the definition of homogenization. People use the same type of things: from planes and cars, holidays destinations and way of dressing and living. With this goes a strong consumerist way of living and structure of principles that focus on the material world and on substantial comfort. Looking at Giddens (1990) and Robertsons (1992) definitions, Giddens believes modernity has come as a result of globalization. For Giddens globalization is said to have started during the sixteenth century onwards and in Europe in particular. However, in Robertsonà ¢Ã¢â€š ¬Ã… ¸s opinion, the problem of globalization is not new. He believes the social compression of the world has begun before the sixteenth century as predicted by Giddens. He predicts modernity and the rise of capitalism to be the cause of the rise of globalization. That is for Robertson, modernization has an influence on globalization. Culture with its very broad nature have always been without a precise definition, referred by Geertz (1973) culture is said not to exist in some ones head. That is, when we are born as we grow, through learning from either our parents or schools or the environment we grow, we know culture. Giddens referred culture to be the way of life of the members of the society or of groups within a society Giddens (2002). He believes that culture is inherited and it comprises both intangible aspects of life like the beliefs, ideas and values, which form the content of culture. In addition, the tangible aspects like the objects, symbols or technology, which represents that content. An example of this is the present day American cultures of Americanization and McDonaldization, described by Ritzer as the fast food restaurants Ritzer, (2003). Geert Hofstede views culture as a communal psychological programming of people. The software of the mentality, or how we think, make us different from additional groups. It refers to a shared fact of mutual principles and meanings and we get it from the social environment. We are not born with a public set of morals and attitudes; we discover and gain them as we develop. E. T. Halls wrote about High- and Low-Context Cultures theories with Low-context cultures we count on complicated verbal explanations, transferring more importance to verbal words, communication is straight and open, meaning is uncomplicated with the High-context cultures we highlight nonverbal communication and use communication as a way to support soft, pleasant associations for example in East Asia and Japan; nonverbal signs and body language are often used as they prefer an indirect, polite, face-saving style that shows a shared sagacity, concern and respect for others. Today as one travels around the world one finds that many airports, hotels and cities are more or less the same this takes the fun out of traveling because you know already how your room is going to be like in certain hotel chain. Globalization is felt particularly in less developed countries, many of which see tourism as an important development option. Unfortunately developing tourism can require that poor countries have to take out billion dollar loans to build the necessary infrastructure for tourism development and this can be a problem because they may not be able to pay their debts. International tourists demand international style hotels, food and drinks and hence developing countries have to import this items, this is called leakage because the money leaks out of the local economy and it cant be used to benefit local people. Cross-cultural exchange promotes innovation and creativity. The belief that increased globalization entails cultural homogenization, most commonly in the guise of Americanization, is a popular one. It is a belief enacted by tourists who travel to far-off lands only to stay in Sheraton hotels, eat at the local McDonalds, and watch big Hollywood pictures in the evenings. The gist of such tourist reports, anthropological findings, and American advertisements has been theorized in models of cultural imperialism (Mattelart 1979; Schiller 1976) that contend that Western, and largely American, culture is exported around the world to the effect of global homogenization. As Featherstone (1995) describes the process, capital clears the way for culture. Along these lines, corporate logos become icons of American ideologies for everyone outside of the center. But are these examples a clear process of cultural homogenization? In this regard, Halls conception of the globalization process is similar to Barbers. However, where Barber understands MacWorld as a totalizing force intent on Americanizing everyone and everything in its path, Hall sees a very peculiar form of homogenization, a homogenization which does not strive for completeness but rather thrives on particularities. For Hall this new form of globalization h as made it chic to eat fifteen different cuisines in any one week (1991). Hall contends that by presenting a world of neutralized difference, a world of commodified and consumable difference, capitalism is able to maintain its global dominance. As he remarks, It is working to make up a nation in which things are diverse. And that is the enjoyment of it but the differences do not matter. (Featherstone 1990) questions the basic premise of Americanization upon which both Barber and Hall build their theories of global cultural homogenization. To begin with, such theories depend upon a notion of cultures behaving as substances which flow intact and easily dissolve the differences they encounter (1995). Yet beyond this distinction, Featherstone contends that the world can no longer be perceived as extending out from one central point such as the United States but rather from many global centers. Like Hall, he highlights the contestatory, confrontational nature of globalization; however, f or Featherstone, the contestation is external rather than internal, a global field in which differences, power struggles and cultural prestige contests are played out. As such, globalization emphasizes cultural heterogeneity and difference of a massive scale: Globalization makes us aware of the sheer volume, diversity and many-sidedness of culture. Featherstone also dismisses the cultural homogenization thesis as premised on ethnocentric ideas about local cultures. When people move around, they carry with them the things that travel bestcultural traditions with sensory power like music, folktales, food ways, and festival. At the same time, it is the sensory power of these traditions which brings them to market, which incorporates them into multicultural policy work, which allows them to serve as somewhat superficial points of cultural exchange. In some senses, the local is globally homogenized in the same way that American (or western) culture is said to homogenize all other culture s: not only does one find McDonalds, Coca-Cola, and Nike around the world; one also finds Chinese food, African music, and May Day celebrations.
